Welcome to GAINR. These Terms of Service ("Terms") govern your use of our mobile application and related services. By accessing or using GAINR, you agree to be bound by these Terms. If you do not agree, do not use our services.
1. ACCEPTANCE OF TERMS
By creating an account, downloading, or using GAINR, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
If you are under 18 years old, you represent that you have obtained parental or guardian consent to use GAINR.
You must be at least 18 years old to use GAINR. We do not knowingly collect information from users under 18.
2. OUR SERVICES
GAINR provides a fitness tracking application that includes:
- Workout logging and tracking
- Nutrition and meal tracking
- Progress photo storage
- Gamification features (XP, levels, badges)
- Global leaderboard competition
- AI-powered food analysis
- Personalized fitness recommendations
We reserve the right to modify, suspend, or discontinue any part of our services at any time without notice.
3. USER ACCOUNTS
3.1 Account Registration
You agree to provide accurate, current, and complete information during registration and keep your account information updated.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:
- Not share your password with others
- Notify us immediately of unauthorized access
- Log out after each session on shared devices
3.3 Account Termination
We reserve the right to suspend or terminate accounts that violate these Terms or engage in prohibited activities.
4. PAYMENTS & BILLING
4.1 Premium Subscriptions
GAINR offers premium subscriptions with the following billing cycles:
- Weekly: $4.99 per week
- Annual: $24.99 per year (Best Value)
4.2 Auto-Renewal
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You will be charged for renewal within 24 hours before the end of the current period.
4.3 Cancellation
You can cancel your subscription at any time through your device settings. Cancellation takes effect at the end of your current billing period. No refunds for partial periods.
4.4 Free Trial
We may offer free trial periods. If you do not cancel before the trial ends, your payment method will be charged for the subscription period.
5. USER CONDUCT
You agree NOT to:
Use GAINR for any illegal purpose or in violation of local, state, national, or international laws.
Harass, abuse, or harm another user, or engage in any form of bullying or intimidation.
Send spam, chain letters, or any other unsolicited communications.
Post false, misleading, or fraudulent content, including fake progress photos.
Impersonate any person or entity, or falsely represent your identity.
Reverse engineer, decompile, or disassemble any part of GAINR.
6. INTELLECTUAL PROPERTY
6.1 Our Content
GAINR and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
6.2 Your Content
You retain ownership of content you submit to GAINR (workout logs, progress photos, etc.). By posting content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and display your content for providing and improving our services.
6.3 Leaderboard
Your username, level, XP, and rank may be publicly displayed on the global leaderboard. You can opt out of public visibility in your account settings.
7. DISCLAIMER
GAINR is a fitness tracking application, not a medical device. The information provided through GAINR is for informational purposes only and should not be considered medical advice.
NOT A MEDICAL PROFESSIONAL: We are not a licensed medical professional. Always consult with a qualified healthcare provider before starting any fitness or nutrition program.
USE AT YOUR OWN RISK: Your use of GAINR is at your own risk. We make no warranties about the completeness, reliability, or accuracy of this information.
INDIVIDUAL RESULTS: Results vary from person to person. Past performance does not guarantee future results.
8. LIMITATION OF LIABILITY
To the maximum extent permitted by law, GAINR and its operators shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or use
- Any damages resulting from interruption of service
- Any unauthorized access to your data
- Any errors or inaccuracies in content
- Injury resulting from use of fitness information
Our total liability in any circumstance shall not exceed the amount you paid us in the past 12 months.
9. TERMINATION
9.1 By You
You may delete your account at any time through the app settings or by contacting support.
9.2 By Us
We may suspend or terminate your account immediately, without prior notice, if we believe you have violated these Terms or engaged in illegal activity.
9.3 Effect of Termination
Upon termination, your right to use GAINR will cease immediately. We may retain certain data as required by law or for legitimate business purposes.
10. GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
Any disputes arising from these Terms or your use of GAINR shall be resolved in the courts of the United States.
